What is a Statutory Demand?

A Statutory Demand is a written notice from a creditor. It is a notice to a debtor that they must repay your debt or come to another arrangement that is acceptable for you or you will take them to court. You can make a Statutory Demand to ask for payment of a debt from an individual or company.

Can I make a Statutory Demand on an old debt?

If the debt’s over 6 years old, you cannot usually make a Statutory Demand. We advise that you get legal advice if your debt is over 6 years old.

What happens when the debtor receives a Statutory Demand?

When the person or organisation that owes you money receives a Statutory Demand, they have 21 days to either repay their debt to you or reach an agreement with you to pay. If they do not respond to the Statutory Demand within 21 days, you can apply to bankrupt your debtor or close their company.

How to deliver the Statutory Demand to the debtor?

You must know the address of the individual/business in order to serve them with the Statutory Demand. If you do not know their address, Bravo Investigations can make a tracing inquiry and find out the address for you. Once you know the address, choose which form you need, fill it in and hand it over to our process server. They will serve the notice on the individual or the company that owes you money. After the notice is served you will receive a confirmation from our server that the debtor has received the Statutory Demand. Keep this confirmation together with the copies of the Statutory Demand, in you will need this in case that your demand is ignored.

What can I do if a Statutory Demand is being ignored?

If your debtor does not pay the debt or agree to your Statutory Demand within 21 days, you can:

  • start bankruptcy proceedings against any individuals who owe you £5,000 or more
  • wind up a company that owes you £750 or more
